The legal dispute between Apple and Qualcomm knows no end. Qualcomm once again challenged the International Trade Commission (ITC), which banned the import of iPhones into the United States. The reason is supposed to be the assignment of several patents by Apple.

The Commission has previously ruled in favor of Qualcomm, but has now decided not to grant a ban on iPhone imports into the US. Qualcomm appealed that decision, and the ITC is now reviewing it again. In September, it was discovered that Apple had violated one of the patents it used in its iPhones with modems from Intel. In normal cases, such a violation would result in an immediate import ban, but the judge then ruled in favor of Apple, saying that such a decision would not be in the public interest.

 

Apple released a software fix a few days later to avoid the import ban itself, but Qualcomm claims that the import should have already been banned by the time Apple worked on the fix. In December, the ITC said it would indeed review its decision, which would depend on several factors. In the first place, it will depend on the time before Apple accepts proposals that do not infringe the patent. Furthermore, whether problems may arise that result from the import ban. And finally, if it will be possible to ban the import of only those iPhones that are affected by patent infringement, i.e. iPhones 7, 7 Plus and 8, 8 Plus.

The commission was originally supposed to make a decision yesterday, but it appears that the dispute will take longer than originally expected. Apple has requested a postponement of up to another six months. Recently, the company was banned from selling iPhones in Germany, and if it wants to continue selling them in our neighbors, it has to modify them.
