Apple has again failed in its request to ban the sale of selected Samsung products infringing the California company's patents. Judge Lucy Koh refused to issue an injunction on the grounds that Apple failed to prove that it actually suffered substantial damages.

Apple's request for banning the sale of nine different Samsung devices comes from the second major lawsuit between the two companies. It culminated in May, when the jury she rewarded Apple will indemnify in the amount of almost 120 million dollars. Apple has already applied for a similar ban in previous years for infringing its patents, but never succeeded. And the result is the same now.

"Apple failed to demonstrate irreparable harm and connect it with the infringement of its three patents by Samsung," wrote Judge Kohová, who has been in charge of the entire case from the beginning. "Apple has failed to prove that it has suffered substantial harm in the form of lost sales or loss of reputation."

The current court decision could help gradually end the patent battle between Apple and Samsung, which has grown to monstrous proportions. At the beginning of August, however, both sides already agreed that lay down his arms outside the United States, and since neither company nor the other company is able to reach such a judgment that would fundamentally eliminate the other even on American soil, it does not make sense to continue in the courtrooms.

After all, even Judge Kohová has already urged both parties several times to come to an agreement and settle their disputes without the help of jurors. The leading representatives of Apple and Samsung have also met several times, but have not yet signed a definitive peace agreement.
